These Terms of Use ("Terms") govern your use of harborglownights.com and its pages (the "Site"). The Site is operated by Glow Works Inc., a California corporation ("Glow Works," "we," "us," or "our"), which produces Harbor Glow™ (the "Event"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Changes apply from the date they are posted. Your continued use of the Site after that date means you accept the updated Terms.
The Site is intended for a general audience but is not directed to children under 13. You must be at least 18, or have a parent or guardian's permission, to submit information through the Site or to purchase tickets.
Dates, hours, programming, scenes, pricing, ticket-sale timing and other operating details shown on the Site are subject to change without notice. Images on the Site labeled "concept imagery" or "design concept" are artistic renderings; final installations may look different. We try to keep the Site accurate but do not guarantee that all information is complete or current.

Tickets for the Event are sold through our authorized ticketing site at tickets.harborglownights.com, which is operated on our behalf by a third-party ticketing provider. Ticket purchases are governed by our Ticketing Terms & Conditions and the Harbor Glow Liability Waiver and Release, each presented at checkout, and by the ticketing provider's checkout terms. Those documents, not these Terms, control any question about ticket sales, refunds, date changes, weather closures, entry and conduct at the Event. Tickets bought from any source other than our authorized ticketing site may not be honored.
The Site and its content — including text, graphics, logos, images, design renderings, scene names and the overall look of the Site — are owned by or licensed to Glow Works and are protected by copyright, trademark and other laws. Harbor Glow™, the Harbor Glow logo, Glow Works and the GW logo are trademarks of Glow Works Inc. Other names and marks shown on the Site, including those of the venue and our partners, belong to their respective owners.
We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the Site for your personal, non-commercial use. You may share links to the Site and post personal social-media content about the Event. You may not otherwise copy, reproduce, modify, distribute or create derivative works from Site content without our prior written permission.
If you sign up for updates, we will send you emails about Harbor Glow, such as ticket-sale announcements, news and offers. You can unsubscribe at any time using the link in any email. Our email service provider processes your sign-up information on our behalf, as described in our Privacy Policy. If you provide a mobile number when purchasing tickets, we may send you text messages about your order and your visit, such as weather or safety closures and schedule changes. We will not send you marketing text messages unless you separately opt in. Reply STOP to opt out at any time.
If you send us comments, feedback, photos or other material, or tag us on social media (for example, with #HarborGlow), you grant Glow Works a non-exclusive, royalty-free, worldwide license to use, reproduce, display and share that material in connection with the Event and our business, including on the Site and our social-media channels, with credit to you where practical. You confirm that you have the right to share the material and that it does not violate anyone else's rights. We are not obligated to use any material you submit. We may ask for your separate permission before featuring your content in paid advertising.
The Site links to or embeds services operated by others, including our ticketing provider, payment processors, our email service provider, map services and social-media platforms. We do not control those services and are not responsible for their content, availability or privacy practices. Your use of them is governed by their own terms and policies. In particular, the Site uses Google Maps features. By using those features, you agree to be bound by the Google Maps/Google Earth Additional Terms of Service (https://maps.google.com/help/terms_maps/) and the Google Terms of Service (https://policies.google.com/terms).
Our Privacy Policy explains how we collect, use and share personal information, including information collected through the Site, our email sign-up and our ticketing site. By using the Site, you acknowledge that your information will be handled as described in the Privacy Policy.
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, GLOW WORKS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). THIS SECTION APPLIES ONLY TO YOUR USE OF THE SITE; LIABILITY RELATING TO TICKETS OR ATTENDANCE AT THE EVENT IS GOVERNED BY THE TICKET TERMS AND THE WAIVER AND RELEASE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
You agree to defend, indemnify and hold harmless Glow Works and its officers, directors, employees, contractors and agents from any claims, losses, liabilities and expenses, including reasonable attorneys' fees, arising out of your violation of these Terms or your misuse of the Site.
If you have a concern about the Site, please contact us first at info@harborglownights.com so we can try to resolve it informally.
If we cannot resolve a dispute informally within 30 days, either party may pursue it in the courts described in Section 16, including small-claims court where the claim qualifies. Disputes relating to tickets or attendance at the Event are governed by the dispute-resolution terms in the Ticketing Terms & Conditions and the Liability Waiver and Release.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. You and Glow Works agree to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
These Terms, together with the Privacy Policy, are the entire agreement between you and Glow Works about the Site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. Sections 7, 9 and 12 through 17 survive any termination of your use of the Site. We may suspend or end your access to the Site at any time if you violate these Terms.
