Liability Waiver & Release

Glow Works may update this Waiver at any time by posting a new version on this page. The version in effect when a ticket is purchased applies to that ticket.

1. Acceptance and assumption of risk

By purchasing, holding, possessing, or using this ticket and/or entering the event, I, and I on behalf of any accompanying or attending minor(s) (together the "Holder") acknowledge that the event involves inherent and other risks, and I assume those risks, including but not limited to lighting effects such as flashing, strobe, and rapidly changing lights, fog, special effects, sounds, darkness, low visibility, crowd, contact with others, uneven and slippery surfaces, weather impacts, wind, proximity to open water, construction activity in surrounding areas, moving attractions and vehicles, ride attractions (including the motorized, rider-operated Dino Ride), and acts or omissions of others. Holder agrees to all terms herein, and that this ticket is subject to all terms established by Glow Works Inc., a California corporation, and/or its affiliates ("Glow Works"), producer of Harbor Glow™ at West Harbor, San Pedro, California (the "event"), as set forth at harborglownights.com. Acceptance, use of this ticket, and/or entering (or seeking entry into) this event and its surrounding locations by Holder constitutes Holder's acceptance of all terms. Holder agrees to follow all safety rules and instructions.

Rides. The Dino Ride is a motorized attraction that riders operate themselves. Holder is responsible for confirming that each rider meets the posted age, weight and other requirements, for following the posted ride rules and ride attendants' instructions, and for supervising any minor who rides.

2. Release and covenant not to sue

HOLDER VOLUNTARILY ASSUMES ALL RISK AND DANGER INCIDENTAL TO THIS EVENT, INCLUDING WITHOUT LIMITATION PERSONAL INJURY, DEATH, SICKNESS/ILLNESS, POTENTIAL EXPOSURE TO COVID-19, OR OTHER COMMUNICABLE DISEASE, LOST, STOLEN, DAMAGED/CONFISCATED PROPERTY, AND OTHER HAZARDS ARISING FROM/RELATED TO, THE EVENT (INCLUDING FULFILLING THE SAFETY REQUIREMENTS), WHETHER OCCURRING PRIOR TO/DURING/AFTER THE EVENT, HOWEVER, CAUSED AND WHETHER BY NEGLIGENCE OR OTHERWISE TO THE FULLEST EXTENT PERMITTED BY LAW ("ASSUMED RISK"). To the fullest extent permitted by applicable law, Holder releases, holds harmless, and covenants not to sue the Released Parties (defined below) for all claims Holder may have (or hereafter accrue) (together, "Claims") against any Released Party arising from Holder's voluntary participation in the event and its activities whether caused by action, inaction or negligence of any Released Party or otherwise, except to the extent caused by conduct that cannot legally be waived or released.

"Released Parties" means:

• Glow Works Inc. and its affiliates, owners, officers, employees, agents, contractors and suppliers;
• San Pedro Public Market LLC and the other owners, developers, managers and operators of West Harbor and the event venue;
• the City of Los Angeles, acting by and through its Board of Harbor Commissioners (Port of Los Angeles);
• each of their respective affiliates, lenders, officers, directors, employees and agents; and
• any other person or entity that Glow Works is required by contract to release, indemnify, or name as an additional insured in connection with the event.

3. Arbitration and class action waiver

ARBITRATION: To the fullest extent permitted by law, Holder agrees that any dispute arising out of or related to this ticket or the event shall be resolved by final and binding arbitration on an individual basis before one neutral arbitrator in Los Angeles, California. Holder waives any right to participate in a class or representative action or class arbitration. Nothing herein shall waive rights that cannot legally be waived.

4. Photo and video release

Glow Works and its partners photograph and record at the event. By entering, Holder agrees to be photographed and recorded, including on behalf of any accompanying minor(s), and grants Glow Works, its affiliates and the owner of West Harbor a perpetual, worldwide, royalty-free right to use those images and recordings, in any media, to promote the event and Glow Works, without payment. Holders who do not want to be featured may tell staff, and Glow Works will make reasonable efforts to leave them out.

5. Warning

WARNING: This event may include flashing/strobe lights, loud sounds, darkness, fog/haze and other special effects that may cause discomfort or adverse reactions in some individuals.

6. General

Severability. If any part of this Waiver is held invalid or unenforceable, the rest remains in full force, and that part is enforced to the maximum extent permitted by law.

Relationship to the Ticketing Terms. This Waiver is separate from, and in addition to, the Harbor Glow Ticketing Terms & Conditions. If the two conflict on assumption of risk, release or dispute resolution, this Waiver controls.
